These Terms of Service ("Terms") form a binding agreement between you and HAPPY CRAB LTD., a company registered in England and Wales under company number 10435896, trading as "Footbeen" ("Footbeen", "we", "us", or "our"). These Terms govern your use of the Footbeen mobile application, footbeen.com, and related services (together, the "Service"). By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.
1. About the Service
Footbeen helps football fans record attended and planned matches, stadium visits, memories, statistics, achievements, and their football journey. The Service may also include profiles, public and private sharing, follows, messaging, invitations, community contributions, location-based features, notifications, imports, and other social or discovery features.
Optional location-based features may process a one-time precise position. Coordinates submitted for stadium verification may be retained in restricted systems for up to 30 days to resolve verification errors and prevent abuse, as described in our Privacy Policy.
The Service is provided for personal, informational, and entertainment purposes. It is not a ticketing, travel, safety, navigation, or official football information service.
2. Eligibility and Accounts
You must be at least 13 years old to create or use a Footbeen account. If you are under the age of legal majority where you live, your parent or legal guardian must review these Terms and permit your use of the Service. We may request age-related information, restrict age-sensitive features, or suspend or delete an account where we reasonably believe these requirements have not been met.
You must provide accurate information, keep your account and sign-in methods secure, and promptly tell us if you believe your account has been compromised. You may not sell, transfer, share, or create accounts for another person without our permission. We may reclaim usernames or restrict account features where reasonably necessary to prevent impersonation, confusion, abuse, or infringement.
3. User Content and License
You may create, upload, submit, send, or share match and stadium visits, profile information, photos, media, memories, captions, comments, ratings, notes, plans, messages, community contributions, and other material ("User Content"). You retain ownership of your User Content.
By creating, uploading, submitting, sending, or sharing User Content, you grant Footbeen a worldwide, non-exclusive, royalty-free, sublicensable, and transferable license to host, store, reproduce, display, publish, distribute, communicate, adapt, crop, resize, format, edit for technical or editorial presentation, create derivative works from, promote, and otherwise use that User Content, together with any associated username, display name, image, or likeness, in connection with operating, securing, moderating, improving, promoting, and marketing Footbeen. This includes use in the Service, on our websites, blogs, social media, emails, app store materials, press materials, product screenshots, advertising, and other Footbeen product or promotional materials.
This license does not transfer ownership to us. To the extent permitted by law, you waive and agree not to assert moral rights in uses permitted by this license. The license ends when the relevant User Content is deleted from our active systems, except for uses already made, material already shared or published, reasonable backup and technical retention, moderation and audit records, and uses required to protect rights or comply with law.
You represent that you own or have all rights, permissions, consents, and releases required for your User Content and our permitted use of it, including permission from identifiable people appearing in photos or media where required. You are responsible for your User Content and must not upload or share material that infringes intellectual property, privacy, publicity, confidentiality, or other rights.
4. Acceptable Use and Community Safety
You must not:
- Use the Service unlawfully, fraudulently, or to facilitate illegal activity
- Attempt to access accounts, data, or systems without authorization, or interfere with the Service
- Scrape, crawl, reverse engineer, or use automated means to access the Service without our written permission, except where law does not allow that restriction
- Impersonate another person, misrepresent your identity, manipulate engagement, or send spam
- Upload malware or content that is illegal, fraudulent, threatening, hateful, sexually explicit, exploitative, harassing, defamatory, privacy-invasive, or otherwise harmful
- Upload content involving the sexual exploitation or abuse of children or use the Service to groom, exploit, or endanger a child
- Upload photos, logos, copyrighted works, personal information, or images of other people without the required rights or permission
You may report suspected illegal, infringing, or harmful content or conduct through available reporting tools or by contacting support@footbeen.com. We review reports according to their severity, credibility, legal requirements, and available information. You may ask us to review a moderation decision by contacting the same address.
5. Football and Third-Party Information
Fixtures, scores, stadium details, club and league information, coordinates, distances, travel information, links, and other data may come from third parties, public sources, community submissions, or automated systems. We may correct or moderate this information, but we do not guarantee that it is complete, current, accurate, or error-free.
You must independently verify important information before travelling, purchasing tickets, attending an event, or making another decision. Footbeen is not responsible for cancelled or rescheduled matches, venue changes, travel disruption, ticket availability, third-party sellers, clubs, venues, or other third-party services. You may not extract, reproduce, or redistribute protected third-party data except as permitted by law.
6. Footbeen Intellectual Property
The Footbeen name, logo, software, design, and original content are owned by or licensed to HAPPY CRAB LTD. Except for the limited right to use the Service under these Terms, no rights are granted to you. Club names, logos, league names, and related trademarks belong to their respective owners and are used for identification purposes only.
7. Communications
By creating an account or using the Service, you agree that Footbeen may send communications reasonably necessary to provide, protect, and administer the Service. These may include sign-in and authentication messages, account and security alerts, fraud or abuse notices, purchase or subscription information, support responses, legal notices, material changes that affect the Service, and messages required to complete an action you request. We may send these essential communications while your account remains active even if you opt out of non-essential communications.
If you enable notifications, you ask Footbeen to send the alert categories you select, which may include match and planning reminders, social activity, messages, feature guidance, service updates, and occasional product updates. You can change notification categories in Footbeen, turn off all Footbeen alerts, or manage permission in your device settings. Push notifications are not required to use the core Service and are not used to send sensitive authentication credentials or confidential account information.
Where permitted by law, we may also send non-essential emails such as product news, guides, reminders, surveys, and occasional promotions. Every non-essential marketing email will provide an unsubscribe method. An email opt-out does not stop essential account, authentication, security, legal, purchase, support, or service-critical communications. We will respect communication choices and obtain separate consent where applicable law requires it.
8. Paid Subscriptions
Footbeen may offer optional auto-renewing subscriptions, including Footbeen+. The available subscription title, features, duration, current price, billing currency, and any introductory offer are shown before purchase. Footbeen+ may be offered monthly or annually. Where the store confirms that you are eligible, the annual plan may include a seven-day free trial; the monthly plan has no free trial. If you do not cancel an eligible annual trial before it ends, it converts to the paid annual subscription shown at purchase.
Subscriptions purchased in the iOS or Android app are processed and charged to your Apple App Store or Google Play account. They renew automatically for the selected period unless cancelled at least as required by the applicable store. You can manage or cancel a subscription in your App Store or Google Play account settings. Deleting your Footbeen account or uninstalling the app does not itself cancel a store subscription. Refunds and store billing disputes are handled under the applicable store's rules, without limiting mandatory consumer rights.
Introductory-offer eligibility is determined by Apple or Google and may not be available to previous subscribers. Prices and taxes may vary by country and store. If a subscription price changes, the applicable store will provide any notice or request any consent required by its rules or law. Paid access belongs to the Footbeen account linked to the purchasing store account and may not be sold or transferred. We will provide the purchased subscription benefits for the paid period, subject to these Terms and reasonable changes that do not remove the subscription's material value.
9. Availability and Changes to the Service
The Service is provided "as is" and "as available". We do not guarantee uninterrupted availability, preservation of every feature, or compatibility with every device. We may add, change, restrict, suspend, or discontinue features or the Service where reasonably necessary for product, security, legal, operational, or commercial reasons.
10. Moderation, Suspension, and Termination
We may, but are not required to, review, preserve, restrict, remove, or refuse to display User Content; limit account functionality; or suspend or terminate accounts where we reasonably believe this is necessary to enforce these Terms, protect Footbeen, users, or third parties, investigate abuse or infringement, comply with law, or reduce legal, safety, security, or operational risk. We may act without prior notice in urgent cases.
You may stop using the Service and delete your account at any time. Deletion and retention are handled as described in our Privacy Policy. When these Terms end, provisions that by their nature should survive will continue, including prior and surviving User Content license rights, intellectual property provisions, indemnities, disclaimers, liability limits, and dispute terms.
11. Indemnity
To the extent permitted by law, you agree to indemnify HAPPY CRAB LTD. and its officers, employees, and contractors against third-party claims, losses, liabilities, and reasonable costs arising from your unlawful User Content, your infringement of another person's rights, or your material misuse of the Service. This does not apply to the extent a claim was caused by our own breach, negligence, or unlawful conduct.
12. Disclaimers
To the maximum extent permitted by law, we disclaim all express and implied warranties, including merchantability, fitness for a particular purpose, accuracy, availability, and non-infringement. We do not endorse or accept responsibility for User Content or third-party content, products, links, services, conduct, or communications.
13. Limitation of Liability
Nothing in these Terms excludes or limits liability that cannot lawfully be excluded or limited, including liability for fraud or fraudulent misrepresentation, death or personal injury caused by negligence, or mandatory consumer rights.
To the maximum extent permitted by law, Footbeen is not liable for indirect, incidental, special, consequential, punitive, or unforeseeable loss; loss caused by User Content or third-party information or services; loss of opportunity, data, goodwill, or anticipated savings; travel or ticket costs; or events outside our reasonable control. Our total aggregate liability relating to the Service will not exceed the greater of £100 or the amount you paid Footbeen during the twelve months before the event giving rise to the claim.
14. Governing Law and Courts
These Terms are governed by the laws of England and Wales, and the courts of England and Wales will have jurisdiction. If you are a consumer, you may also rely on mandatory protections and bring proceedings in any courts available to you under the laws of your country of residence.
15. Changes to These Terms
We may update these Terms to reflect changes to the Service, our business, safety requirements, or the law. We will provide appropriate notice of material changes. Unless stated otherwise, updated Terms apply from the last-updated date shown on this page. If you continue to use the Service after that date, you agree to the updated Terms to the extent permitted by law.
